Wallcraft guarantee.

1.1 This express manufacturer guarantee applies only to Wallcraft products for which a guarantee period is stated on the product packaging, product page or other written Wallcraft product information applicable at the date of purchase.

1.2 The guarantee period is the period stated for the eligible product. It runs from the purchase date recorded on the proof of purchase.

1.3 To register this express guarantee, the customer should submit a complete online registration within 30 days of purchase and retain proof of purchase. Registrations submitted later may be reviewed by Wallchem Manufacturing.

1.4 The product must have been paid for in full and used within the Republic of South Africa.

1.5 Settlement of a claim does not restart or extend the original guarantee period.

1.6 This express guarantee is in addition to any statutory rights available to the consumer and does not exclude, waive or reduce rights that may not lawfully be excluded.

2.1 The substrate must be suitable, sound and properly prepared before coating.

2.2 Preparation, priming, application, spreading rate, number of coats, drying conditions and any other system requirements must comply with the applicable Wallcraft technical information and instructions.

2.3 Recommended preparation products, primers, undercoats or compatible system components must be used where specified.

2.4 The product must be used only for the surfaces and applications for which it is intended.

2.5 Moisture ingress, rising damp, active leaks, ponding water, defective drainage and other building or substrate defects must be corrected before coating where relevant.

2.6 The coated surface must be maintained in accordance with the product-specific maintenance guidance. Where specified for the product/system, this may include periodic inspection, cleaning and a maintenance coat at approximately five-year intervals or another interval stated by Wallcraft.

The express guarantee does not cover failure caused wholly or partly by circumstances outside the performance of the supplied Wallcraft coating, including:

3.1 failure of, or poor adhesion to, an existing coating or substrate not supplied by Wallchem Manufacturing;

3.2 structural movement, cracking, settlement, deterioration or failure of the substrate or building materials;

3.3 unresolved moisture, water ingress, ponding, poor drainage or unsuitable airflow where these conditions affect coating performance;

3.4 application over chalky, friable, contaminated, rusted or incompatible surfaces without the preparation required by the applicable product instructions;

3.5 incorrect mixing, dilution, tinting, preparation or application, or failure to follow the relevant technical instructions;

3.6 mechanical damage, impact, abrasion beyond the intended use, vandalism, fire, flooding, extreme weather, chemical contamination, pollution or other external causes outside Wallchem Manufacturing's reasonable control;

3.7 use outside the product's intended purpose or application;

3.8 shelf life or deterioration of unused product after the applicable storage period.

4.1 Subject to assessment and acceptance of a valid claim under this express guarantee, Wallchem Manufacturing will provide replacement Wallcraft coating product reasonably required to address the accepted coating failure.

4.2 The replacement-product value reduces on a straight-line pro-rata basis over the stated express guarantee period. For example, under a 10-year express guarantee, the express-guarantee replacement-product value reduces by 10% at each completed anniversary.

4.3 Unless applicable law requires otherwise, this express guarantee does not include removal or stripping of existing coatings, surface preparation labour, reapplication labour, scaffolding, access equipment, contractor costs, loss of use, lost profit or other indirect or consequential loss.

4.4 These express-guarantee limitations do not limit remedies or liabilities that may not lawfully be excluded.

5.1 Notify Wallchem Manufacturing in writing as soon as reasonably practicable after discovering a suspected failure and, where reasonably possible, within 30 days of discovery.

5.2 Provide the registration reference, proof of purchase and reasonable supporting information requested for assessment, which may include photographs, batch information, samples, preparation details and application records.

5.3 Wallchem Manufacturing may inspect the affected area itself or appoint a representative or independent coating consultant to assist with assessment.

5.4 Unless urgent work is required to prevent further property damage or for safety, do not remove, repair or coat over the affected area before Wallchem Manufacturing has had a reasonable opportunity to inspect it.

5.5 If Wallchem Manufacturing agrees to support remedial work beyond supply of replacement product, it may specify reasonable requirements for the remedial coating system and applicator.

6.1 The terms applicable to a registered express guarantee are the terms made available to the customer when the guarantee is registered, subject always to applicable law.

6.2 Wallchem Manufacturing may update guarantee terms prospectively, but an update will not retrospectively reduce an existing registered guarantee or any right that may not lawfully be excluded.
